JANA

Terms of sale and licence

Version of 12 October 2026, published ahead of release. These terms take effect on the day the Jana 965 goes on sale. That day is to be announced, and until then nothing is sold and no licence is issued.

Who we are

These terms are between you and Talal Bouroki, trading as Jana Audio, a sole proprietor in Kuwait ("we", "us").

Who sells it to you

We sell through FastSpring (Bright Market, LLC d/b/a FastSpring in the USA, FastSpring B.V. in the Netherlands, FastSpring Limited in England, or SalesRight Technologies ULC d/b/a FastSpring in Canada, the companies its buyer terms name), our reseller and the merchant of record for every order: FastSpring concludes the sale with you, takes the payment, charges and accounts for any sales tax or VAT, and issues your receipt, and its name is the one on your receipt and card statement. FastSpring's buyer terms govern the payment and the purchase between you and FastSpring. Questions about a charge, a receipt or tax can go to FastSpring at fastspring.com/consumer-support, or to us, and we will pass them on. Support, fixes and updates come from us.

The rest of these terms are between you and us, and they are the licence: what you may do with the Jana 965 and its cards, and what we owe you.

What you are buying

What you buy is a licence to use the software, not the software itself, which stays ours.

Price and delivery

The price is the one shown on our site and at checkout, in US dollars, with any sales tax or VAT added at checkout and shown before you pay.

Your licence is delivered as soon as the payment is confirmed: by email, always, as a licence file, and also straight to the plugin if you bought from it. Buying from the EU or the UK? See the refund policy for what that means for your right to withdraw.

The licence

We grant you a perpetual, non-exclusive licence to use the Jana 965 and the cards your licence names, for any purpose, commercial work included.

Activation

Your licence is a signed file that the plugin checks on your own computer: no expiry, no periodic check, and no need to be online to use it.

Activating online is optional and counts up to five computers per account at a time; you can deactivate a computer yourself, from the plugin or your account page, to free its place. A licence file you load by hand is not counted and always works on its own. What the plugin sends when it goes online, and what we keep, is in the privacy notice.

The trial

Without a licence, the Jana 965 runs as a trial: the whole plugin and every card, free, with no time limit and nothing switched off, and you may use it for any purpose. In the trial, settings are not brought back when a session is reopened, and presets and defaults do not save; the 965 still writes its settings into your sessions, and buying brings them back. The trial is under these terms too, apart from the price.

Updates

Free updates for life. Every update to the Jana 965 and to every card your licence names is free: fixes, support for new host and system versions, new features, and the 965 on every platform we release it for, for as long as we make it, under the same licence. We do not promise any particular update, and a different product under its own name is not an update to the 965.

When a licence ends

If a payment is reversed (a chargeback), refunded, or found to be fraudulent, or an order is an accidental duplicate, the licence from that order is revoked: we stop serving it, and a computer that next contacts our licence server moves the file out of use. We may also revoke a licence that has been published or shared against these terms. Otherwise we never revoke a licence.

If something is wrong

If the 965 does not work as we describe it, tell us and we will fix it. The trial is there so you can check that it works in your own setup before you pay. Apart from that, the software is provided as it is: we do not promise that it suits every purpose, host or computer, or that it is free of every fault. Nothing in these terms takes away the rights the consumer law of your country gives you.

Liability

Our total liability to you under these terms is limited to the price you paid for the licence concerned. We are not liable for indirect or consequential loss, such as lost work, lost data or lost income: keep backups of your sessions. Nothing here limits liability that the law does not allow to be limited, such as liability for fraud, or for death or personal injury caused by negligence.

Law

These terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have jurisdiction over any dispute about them. If you buy as a consumer, you also keep the protection of the mandatory laws of the country you live in, and you may bring a claim there.

Changes

The terms that apply to a purchase are the ones published on the day you made it. We may change these terms for later purchases; the date at the top says which version this is.
